HR computer forensic investigation

25 November 2013

Socially Responsible Employer

A family run engineering business that had been at the heart of their community for a number of years, faced a difficult dilemma. An employee reported seeing another employee browsing the internet and viewing what were believed to be indecent images of children.

Clearly the company took decisive action and started an internal investigation. The employee was suspended, pending the investigation. As the company had very limited evidence, the local Police Constabulary did not have sufficient evidence to proceed with a full investigation in the timescale required by the company’s own internal disciplinary procedures.

IntaForensics were consulted, and we were able to offer a preliminary analysis of the digital evidence within a few days of the report having been made to the company. We recovered evidence of inappropriate use of computer equipment – thankfully falling short of indecent images of children being found on the computer. We provided the company with a comprehensive report outlining the internet browsing history of the users account, the dates and times when the access occurred and the details of what they had been doing. In this case it amounted to accessing prostitution and hard core pornographic web-sites rather than child abuse images or indecent images of children.

Our ability to react quickly, and enabling the company to have a comprehensive technical report back within 5 days of the initial reporting of the incident, enabled the company to handle their internal investigation without substantial delays. The evidence produced enabled them to discuss their investigation findings with the employee and have confidence that they had a sufficient grounds for dismissal on the basis of Gross Misconduct.
