Mobile Evidence Recovery in Family Court Proceedings

Introduction

In family law proceedings, digital evidence often plays a critical role in decisions concerning the welfare of children. IntaForensics is regularly instructed to extract and present communications from mobile devices to assist the court in assessing the conduct of individuals involved in custody disputes. In one such case, our forensic expertise and persistence enabled the recovery of vital messaging data that had initially appeared inaccessible.

Background

Family court cases frequently involve disputes between parents or guardians over the custody and care of children. Where risk is alleged, the court may order the examination of mobile phones to review communications that could support or challenge claims of inappropriate behaviour or concern.

In this case, two mobile phones were submitted for examination under a court order. The goal was to extract communications, including photos and videos, from popular messaging platforms such as WhatsApp, Facebook Messenger, iMessage, and standard text messaging.

The Challenge

While one device allowed for a full forensic extraction of communications data, the second presented multiple obstacles. The key applications, Messenger and WhatsApp, had been deleted from the device, and standard recovery methods did not yield local backups or accessible residual data.

Accessing the data via the web versions of these services required successful login to the associated accounts. However, the SIM card in the device was no longer active, and neither account had been linked to an email address, creating a barrier to the multi-factor authentication process required by both platforms.

This presented a dual challenge: retrieving critical communications and finding a legitimate method to bypass authentication restrictions without compromising security or process integrity.

The Solution

IntaForensics undertook a full forensic and procedural review to recover the data while complying with legal and platform-specific requirements. The following steps were taken:

Full file extraction and manual examination

We conducted a forensic extraction of both handsets to retrieve communications, media, and application data where available. A manual review of app activity helped assess which accounts and services had been in use.

Web-based account recovery attempt

We initiated login attempts via web-based versions of WhatsApp and Messenger, identifying the requirement for two-factor authentication codes delivered via SMS to the original SIM card.

Assessment of authentication options

We confirmed that no email addresses had been linked to the accounts and that the inactive SIM card was the sole route for account access recovery.

Coordination with telecoms provider

Under instruction from legal counsel, we facilitated communication with the relevant telecoms providers. With a court order in place, the operator agreed to temporarily reactivate the SIM to allow SMS receipt.

Successful account access and data retrieval

Once the SIM was live, we completed the authentication process, accessed both online accounts, and downloaded the full messaging histories. The extracted data was then reviewed, formatted, and presented in a report designed for clarity in court.

Our persistence ensured that the data, initially thought to be lost or inaccessible, was successfully recovered and contributed to the court’s understanding of the case.

Our Findings

The recovered messaging content provided crucial insights into the relationship dynamics and behaviour of the parties involved. While the technical path to retrieve the data was complex, the outcome highlighted the importance of both forensic capability and procedural tenacity in family law investigations.

This case underscores IntaForensics’ commitment to working through barriers, both technical and administrative, to ensure vital digital evidence is not overlooked in matters where child safety and court outcomes are at stake.
